Welcome to NicheHunt. By accessing or using NicheHunt ("the Service"), operated by Aezis AI ("we," "our," or "us"), you explicitly agree to be bound by these comprehensive Terms and Conditions ("Terms").

If you disagree with any part of these Terms, you may not access or use our Service. These Terms apply to all visitors, users, and others who access the Service.

02.Eligibility & Age Requirements

You must be at least 18 years old to use NicheHunt.

You must be at least 18 years of age to create an account and use the Service. By agreeing to these Terms, you represent and warrant that you meet this age requirement.

If you are accessing the Service on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

03.Description of Service & User Accounts

NicheHunt is an advanced AI-powered platform designed specifically to provide predictive analytics, intelligent content generation, and deep niche research tools for modern creators.

Account Obligations

• You must provide accurate, complete, and current information at all times.
• You are entirely responsible for safeguarding your password and local machine.
• You must notify us immediately of any unauthorized use of your account.
• Failure to maintain valid information constitutes a fundamental breach of these Terms.

04.Accepted Use & Content Restrictions

To ensure the stability and safety of the NicheHunt platform for all creators, you strictly agree NOT to use the Service:

✗In any way that violates any applicable national or international law.
✗To attempt to bypass, disable, exploit, or interfere with security features.
✗To spam, scrape, ping, or systematically extract data without authorization.
✗To generate content that is actively illegal, abusive, or defamatory.

05.Intellectual Property & Output Rights

We own the platform; you own the outputs the AI generates for you.

Our Property

The Service, including its source code, "NicheHunt" branding, user interface designs, and proprietary algorithms, remains the sole property of Aezis AI and its licensors. The Service is legally protected by copyright, trademark, and other domestic and international laws.

Your Output

Subject to your compliance with these Terms, Aezis AI hereby assigns to you all rights, title, and interest in and to the specific outputs generated by the AI for your account (including niche reports, analytics summaries, and generated content). You are responsible for ensuring that your use of the outputs does not violate any third-party rights.

Your Data & AI Training

We respect your privacy. We do not use your proprietary data, account-specific inputs, or generated outputs to train our global AI models. Your data is used solely to deliver and improve the Service for your individual account.

06.Subscription, Payments & Refunds

In Brief

Free tier requires no payment. Paid plans are billed monthly. No refunds for partial months.

• Free Tier: NicheHunt offers a free tier with limited features. No credit card is required.
• Paid Plans: Paid subscriptions are billed on a recurring monthly basis. You authorize us to charge your payment method at the start of each billing cycle.
• Payment Failure: If a payment fails, your account may be downgraded to the free tier until the payment issue is resolved.
• Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period.
• Refund Policy: We do not provide refunds for partial billing periods. All fees are non-refundable except where required by applicable law.

07. Disclaimer of Liability

Important Legal Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the accuracy, reliability, or availability of the Service, including the AI-generated outputs, metrics, insights, or analytics provided.

Financial Risk Acknowledgment

NicheHunt provides predictive data and analytical insights. You acknowledge that "predictive" does not mean "guaranteed." Any business, financial, or content decisions you make based on the Service are made entirely at your own risk.

Liability Cap

To the maximum extent permitted by applicable law, Aezis AI's total aggregate liability for any and all claims arising out of or related to these Terms or the Service shall not exceed the total amount paid by you to Aezis AI for the Service during the twelve (12) months immediately preceding the event giving rise to the claim.

In no event shall NicheHunt, Aezis AI, nor its directors, partners, or affiliates, be liable for any indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, the Service.

08. Account Termination

In Brief

We can suspend or terminate your account if you violate these Terms or for any reason with notice.

We reserve the right to suspend or terminate your account and access to the Service, at our sole discretion, at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

• Breach of these Terms or any applicable policies.
• Conduct that we determine, in our sole discretion, is harmful to other users, third parties, or the business interests of Aezis AI.
• Requests by law enforcement or government agencies.

Upon termination, your right to use the Service will immediately cease. You may request deletion of your account data by contacting us at info@aezisai.com.

09.Governing Law & Dispute Resolution

These terms are governed by the laws of the State of Maryland, USA.

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States of America, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its rules. The arbitration shall take place in Maryland, and the arbitrator's decision shall be final and binding.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

10.Privacy & Data Protection

Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, and protect your personal data. By using the Service, you consent to the practices described in our Privacy Policy.

We are committed to complying with applicable data protection regulations, including GDPR and CCPA, where applicable.

11.Third-Party Services & YouTube API

Our Service utilizes the YouTube API Services to gather data and analytics. By using NicheHunt, you explicitly agree to be bound by the YouTube Terms of Service and the Google Privacy Policy.

You may revoke NicheHunt's access to your data at any time by visiting the Google Security Settings page.

12.Contact & Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect (via email or in-app notification). Your continued use of the Service after such changes constitutes acceptance of the new Terms.
